Introduction.
The 21st century has witnessed an explosion of interest in outer space, encompassing satellite technology, commercial exploration, and new global regulatory debates. While traditionally dominated by major powers such as the United States, Russia, China, and the European Union, space has become a new frontier for developing regions. Africa, with its fast-growing economies, digital transformation, and increasing reliance on space-based technologies, cannot afford to remain on the margins. This article examines how Africa fits into the evolving global space order, the gaps in its regulatory frameworks, and the opportunities it has to shape a uniquely African approach to space law and policy.
Historical & Legal Background.
International space law developed primarily during the Cold War era, when the two superpowers, the United States and the Soviet Union, sought to prevent an arms race in outer space. The cornerstone is the 1967 Outer Space Treaty (OST), which establishes space as the “province of all mankind,” to be used exclusively for peaceful purposes. It prohibits national appropriation of outer space by sovereignty claims, use, or occupation, and places responsibility on states for both governmental and private space activities. The OST also imposes liability for damage caused by space objects and requires international cooperation and assistance in space exploration.
Subsequent instruments supplemented the OST. The Rescue Agreement (1968) obliges states to assist astronauts in distress. The Liability Convention (1972) codifies absolute liability for damage caused on Earth and fault-based liability in outer space. The Registration Convention (1976) requires states to maintain national registries of space objects. The Moon Agreement (1979) sought to extend OST principles to celestial bodies, designating the Moon and its resources as the “common heritage of mankind.” However, it has received limited ratification, with no major spacefaring states acceding.
Within Africa, the majority of states are parties to the OST and related treaties, but domestic implementing legislation remains sparse. While countries such as Nigeria, South Africa, and Kenya have established national space agencies or enacted regulatory measures, many others lack dedicated legal frameworks. At the continental level, the African Union (AU) has recognized space as a strategic resource for socio-economic transformation. The adoption of the African Space Policy and Strategy (2016) marked a turning point, calling for coordinated regional capacity-building, harmonized regulation, and the integration of space technology into development agendas.
Africa’s Emerging Space Sector.
Africa is no longer a passive consumer of space technology but is steadily carving out its own presence in the global space arena. In the past two decades, several African states have transitioned from reliance on foreign satellites to launching and operating their own space assets, establishing national space agencies, and engaging in international collaborations. From Nigeria’s early investments in Earth observation satellites, to South Africa’s leadership in astronomy and ground station services, to the more recent milestones of Kenya, Ethiopia, and Egypt, the continent is entering a new phase of technological ambition. These developments are not merely symbolic; they are driven by pressing socio-economic needs, climate resilience, food security, communication, and disaster management, making space technologies an indispensable tool for Africa’s development agenda.
These ambitions come to life through concrete national programmes, each reflecting different priorities from Nigeria’s satellites for agriculture and disaster management, to South Africa’s deep-space tracking facilities, and to Kenya, Ethiopia, and Egypt’s recent launches, together illustrating the diversity and growth of Africa’s space sector.
Nigeria was one of the first African countries to establish a dedicated national space agency, the National Space Research and Development Agency (NASRDA) on the 5th of May 1999 saddled with the ambitious task of developing Nigeria’s Space Science and Technology Programme. Nigeria in 1976 during a joint session of the UN Economic Commission for Africa and the Organization of African Union first expressed its ambition to join the elite league of nations with outer space programs. Preparatory policies followed between 1976 to 1980, leading to the establishment of a 10million naira National Remote Sensing Centre which started operation in 1996. A blueprint of what later became known as NASRDA was contained in the National Space Science and Technology Policy drafted by a nine-man committee.
Nigeria entered the space arena with NigeriaSat-1 in 2003, an Earth observation satellite built in the UK and launched from Russia. In 2007, it launched Africa’s first communications satellite, NigComSat-1, which failed in orbit but was replaced at no extra cost with NigComSat-1R. In 2011, Nigeria added two more observation satellites, NigeriaSat-2 and NigeriaSat-X, both carrying high-resolution cameras, with the latter built by Nigerian engineers under UK training as part of a technology transfer programme. This has supported agriculture, urban planning, and disaster monitoring, while NigComSat-1R provides telecommunications services.
South Africa remains a continental leader through the South African National Space Agency (SANSA), which supports Earth observation and space science initiatives. It also hosts the Square Kilometer Array (SKA), the world’s largest radio telescope, and recently provided tracking services for the IM-2 lunar mission, showcasing Africa’s role in interplanetary exploration. After Kenya’s first nano-satellite (1KUNS-PF) in 2018, Kenya advanced further with the launch of Taifa-1 in 2023, its first operational Earth observation satellite. These initiatives, supported by partnerships with international agencies, aim to enhance agricultural monitoring, climate resilience, and natural resource management.
Ethiopia launched its first satellite (ETRSS-1) in 2019 and has announced plans for a higher-resolution satellite (ETRSS-2) expected in 2026. In 2025, Ethiopia unveiled a 12-metre satellite ground station to enhance its capacity in data collection, tracking, and disaster management.
Egypt has one of Africa’s longest traditions in space activity, with multiple Earth observation projects since the 1990s. The EgyptSat-A satellite, launched in 2019, remains operational, while the Egyptian Space Agency (EgSA) oversees a growing portfolio of missions, including the launch of NEXSAT-1 in 2024. In 2025, Cairo also became the headquarters of the African Space Agency (AfSA), cementing Egypt’s role as a regional hub for space governance.
Together, these case studies highlight Africa’s diverse but converging motivations for space exploration, advancing science, strengthening sovereignty, and meeting urgent development needs. They also signal the importance of building robust legal and policy frameworks to sustain this growth and ensure that Africa is not left behind in shaping the global governance of outer space.
Policy and Regulatory Gaps.
While Africa’s space ambitions have grown steadily over the past two decades, the legal and policy frameworks that should underpin these activities remain underdeveloped. Unlike established spacefaring nations that have crafted comprehensive national space laws and regulatory bodies, most African states still rely on fragmented or outdated statutes, leaving uncertainties over issues such as liability, licensing, and private sector participation. This regulatory vacuum not only undermines Africa’s ability to maximize the benefits of space technologies but also exposes states to legal and financial risks in an increasingly commercialized and competitive global space environment.
1.Fragmented National Legislation.
Only a few African states — notably South Africa, Nigeria, and Algeria — have enacted dedicated space legislation or established regulatory authorities.¹ In most other states, space activities fall under general telecommunications, science, or defence laws. This fragmentation results in regulatory uncertainty, particularly regarding the licensing of private operators, spectrum allocation, and compliance with international obligations such as registration and liability. Without harmonized domestic laws, states may struggle to enforce oversight or attract investment into their space sectors.
2. Limited Institutional Capacity.
National space agencies, where they exist, often suffer from inadequate funding, human capital shortages, and weak infrastructure. For example, Nigeria’s NASRDA has launched multiple satellites but has faced criticism over sustainability and limited integration into broader development planning. Smaller agencies, like those in Kenya and Ethiopia, rely heavily on foreign partnerships for launches, training, and ground infrastructure, raising concerns about long-term autonomy and technological independence.
3. Absence of Binding Regional Legal Instruments.
The African Union’s Space Policy and Strategy (2016) is an important milestone, but it remains a soft law instrument, aspirational rather than binding. The creation of the African Space Agency (AfSA) in Cairo in 2019, formally inaugurated in April 2025, has raised hopes for stronger coordination.⁶ Yet, AfSA is still in its formative phase and lacks the enforcement authority seen in agencies such as the European Space Agency (ESA). Without binding regional instruments, continental integration in space governance remains limited.
4. Liability and Insurance Challenges.
Although many African states are parties to the Liability Convention (1972), few have developed national frameworks to implement its provisions. This creates significant risks: if a satellite launched on behalf of an African state causes damage, the state may be held internationally liable without clear domestic mechanisms for insurance, indemnity, or risk allocation. The absence of insurance requirements for private operators also discourages foreign investment and undermines the credibility of African space programmes.
5. Private Sector Regulation.
Private sector participation in African space activities is growing, with start-ups and university-led projects emerging in Kenya, South Africa, and Nigeria. Yet, most states lack licensing procedures, contractual frameworks, or liability regimes to govern private launches and satellite operations. This legal gap exposes states to the risk of being held internationally responsible for private actions under the OST, while deterring innovation by leaving entrepreneurs uncertain about their rights and obligations.
Opportunities and Strategic Considerations.
Africa’s relatively late entry into space exploration does not have to be a disadvantage. On the contrary, it provides unique opportunities to design regulatory and institutional frameworks that learn from global best practices, avoid earlier mistakes, and tailor space activities to the continent’s development needs. Several opportunities stand out:
1. Leapfrogging Technologies.
African states can leapfrog the costly infrastructure of early spacefaring nations by focusing on nano-satellites and CubeSats, which are cheaper, quicker to deploy, and often developed in collaboration with universities. For instance, Kenya’s 1KUNS-PF (2018) and Taifa-1 (2023) demonstrate how a country with limited resources can enter space activities through small satellites. Similarly, South African start-ups have supplied over 100 satellite subsystems for international missions, showing that African firms can integrate into global supply chains.
2. Continental Integration.
The establishment of the African Space Agency (AfSA) in Cairo creates a platform for pooling resources, avoiding duplication, and promoting intra-African collaboration. AfSA can help harmonize frequency applications before the ITU, coordinate shared earth observation constellations, and develop continental training hubs. This mirrors the European Space Agency (ESA) model, where pooling sovereignty allowed smaller European states to compete globally.
Conclusion:
Space is rapidly becoming a new frontier for Africa, not just technologically but also legally and institutionally. The continent faces a dual imperative: to safeguard its interests in the evolving global governance of outer space, and to craft domestic and regional frameworks that enable responsible, inclusive, and sustainable space activities. As African states expand their footprint beyond Earth, the question is no longer whether Africa should engage in space law and policy, but how effectively it can shape the rules of the game.
